I forgot to thank the 3rd circuit for recently clarifying that algorithmic curation such as recommending content is a First Amendment-protected publishing activity, therefore Section 230 immunity doesn’t apply and Tiktok can be held liable for people dying (or damages flowing) as a result of challenges that show up in users’ FYP pages. A shy first step, but a big step forward. About time to kick section 230 out of orbit. We need more judges like de Moraes.
